General Terms and Conditions of Sale

Article 1 - Scope of Application
These General Terms and Conditions of Sale apply automatically to all sales of tourist guide services. The sale is deemed concluded on the date of written consent serving as a binding contract confirming acceptance of the sales and payment conditions between Secrets d’Artisans Japonais, represented by Julie BAUD, and the Client.

Any order implies full and unconditional acceptance of these General Terms and Conditions of Sale and Payment, which prevail over any other conditions, except those expressly accepted by Secrets d’Artisans Japonais. All the General Terms and Conditions of the website are governed by Japanese law, based on the Japanese Act on Specified Commercial Transactions (特定商取引法に基づく表示, Notification based on Specific Trade Law).

Article 2 - Orders
Any service provision or reservation, to be valid, must be established by a sales contract in the form of a quotation or email sent by Secrets d’Artisans Japonais and approved in writing by the Client.

Business hours are Monday to Friday from 10:00 AM to 6:00 PM. The company is closed on Saturdays and Sundays. Please note that we are unable to process modification or refund requests received by email outside of these business hours. Please take into account the time difference with Japan.

Article 3 - Services
In addition to accepting these General Terms and Conditions governing the relationship between Secrets d’Artisans Japonais and the Client, the Client must, for each order, read and accept the general terms and conditions of sale of the Partner with whom the contract is concluded.

Secrets d’Artisans Japonais offers the Client the creation of a custom-made travel program, tailored to their tastes and preferences, including visits and experiences, chauffeured car rental, accompaniment and guide services, as well as other services. Secrets d’Artisans Japonais provides the Client with destination suggestions, itineraries and tourist services in order to define the structure and budget of the stay.

Article 4 - Reservations
To obtain a custom-made travel offer, the Client must send a quotation request to Secrets d’Artisans Japonais via the contact form available on the website or directly by email.

Secrets d’Artisans Japonais will then propose a comprehensive program with an indicative price. The program and the price may be adjusted to better meet the Client’s request, up to a maximum of three proposals. If none of the three proposals is accepted by the Client, a payment of five percent of the amount of the final quotation will be required in order to compensate for the time spent by Secrets d’Artisans Japonais on preparing the proposals.

Once the program is validated by the Client, Secrets d’Artisans Japonais will send a detailed program along with its final and fixed price, inclusive of all fees, taxes and services. This email will include a payment link for one hundred percent of the total price, valid for one month. The reservation will only be considered confirmed once full payment has been received.

To finalize the order, the Client must provide, no later than one week before the tour, the names of the participants, the number of participants, billing address or billing details, an email address and a phone number. Secrets d’Artisans Japonais will then book all services included in the stay in the name and on behalf of the Client.

The timeframe for completing the service request depends on the schedule and deadline agreed upon between Secrets d’Artisans Japonais and the Client. If the quotation is not confirmed by the Client at least one month before the tour, it will be automatically cancelled.

Article 5 - Prices
The final price is defined in the quotation sent by email and must be approved in writing by the Client. The full invoice amount must be paid upon acceptance of the quotation and no later than one week before the start of the tour, except in specific cases. All services are taxes included. No reservation will be confirmed and no invoice issued without full payment at the time of acceptance of the quotation.

Secrets d’Artisans Japonais reserves the right to modify its prices at any time but commits to invoicing the service at the price indicated at the time the order is registered. If an additional hour is requested at the last minute during the same service, it will be charged and must be paid in cash at the time of the request. Secrets d’Artisans Japonais reserves the right to refuse any additional hour.

Article 6 - Payment Terms
Payment must be made by credit card directly on the booking platform or by bank transfer. Full payment of the tour must be completed at least one week before the tour date.

The tour day and the availability of the artisan are confirmed only after receipt of full payment.

An invoice may be issued to individual clients upon request at the end of each guided service. Requests should be sent by email to secretsdartisans.info@gmail.com.

Article 7 - Modification and Cancellation of Reservations
Any modification relating to the characteristics of the guided tour, including schedule, content or number of participants, must be notified as early as possible and will be taken into account subject to the guide’s availability and capacity. Additional fees may apply.

In cases where cancellation is attributable to Secrets d’Artisans Japonais, the company commits to being present on the date, time and meeting point specified at the time of booking.

In the event of force majeure or exceptional circumstances preventing the service from being provided, such as illness or accident, the Client will be informed by any means. The tour may then be entrusted to a partner guide, replaced by an equivalent service, or adjusted by mutual agreement. If a full cancellation is unavoidable, the Client will be refunded in full without penalty.

When cancellation is attributable to the Client, the following cancellation fees apply. A full refund applies up to thirty days before the tour date. An eighty five percent refund applies up to seven days before the tour date. A fifty percent refund applies between seven days and forty eight hours before the tour date. No refund applies less than forty eight hours before the tour date.

The Client must ensure arrival on time at the agreed meeting point. If the Client cancels after the scheduled meeting time or fails to appear, no refund will be issued.

Without notice from the Client, the guide will wait for thirty minutes after the scheduled meeting time. After this period, the guide reserves the right to cancel the service without refund. In the event of a delayed flight arrival in Japan or a missed connection, Secrets d’Artisans Japonais will make its best efforts to reschedule the service, subject to the availability of one or more partners.

In cases of force majeure, service providers reserve the right to cancel any reservation and to modify the service date. This includes, but is not limited to, transport strikes, demonstrations, hotel staff strikes, weather conditions, natural disasters, closure of establishments or geographical constraints.

If the provider is required to cancel the service before the Client has begun the activity, a rescheduling will be offered. In specific and justified cases, subject to supporting documents, refund conditions may be reviewed on a case by case basis.

Article 8 - Refunds
When refunds are authorized under these terms, they will be processed within a maximum period of fifteen days from the date of withdrawal.

Article 9 - Disputes and Complaints
Secrets d’Artisans Japonais cannot be held responsible for inappropriate behavior by the Client during the guided tour or accompaniment service, nor for damage caused to third party property. In the event of a complaint, the parties will attempt to reach an amicable agreement. In the event of a dispute, these General Terms and Conditions are governed by Japanese law, and any dispute relating to their interpretation or execution falls under the jurisdiction of the Japanese courts.

Article 10 - Jurisdiction
Failing an amicable settlement within a maximum period of three months, any dispute arising from the validity, interpretation or execution of these General Terms and Conditions, or resulting therefrom, shall fall under the exclusive jurisdiction of the courts of Nagoya.
